Arizona Immigration Case: The Judge Got It Wrong

Yesterday's decision by U.S. District Judge Susan Bolton is just  another example of an activist Judge putting their ideas ahead of the law. Judge Bolton in the very first page of her opinion notes, "Against
a backdrop of rampant illegal immigration, escalating drug and human trafficking crimes, and serious public safety concerns, the Arizona Legislature enacted a set of statutes and statutory amendments in the
form of Senate Bill 1070, the "Support Our Law Enforcement and Safe Neighborhoods Act."

Yet her decision did nothing to help the people of Arizona deal with these "serious public safety concerns." Instead, she chose to put the politics of the Obama Administration ahead of the welfare of the
people. Keep in mind that Judge Bolton could have simply let the matter move ahead for a full hearing on the merits of the case, rather than picking the law apart as she chose to do.

Her decision to piece-meal the parts of the Arizona law is a clear indication that she simply intended to make a political statement, rather than apply established law in reaching a fair and equitable
decision. I suspect that Judge Bolton was willing to take this bold step of legislating from the bench because she knew that she would have the consistently ultra liberal 9th Circuit Court of Appeals backing up her
decision.

The fact that our country has even gotten to this point is troubling enough. Like you, I'm upset that the federal government decided to sue a state - a state that is simply trying to protect
itself. That's like you using a garden hose to put out a fire at your own house - and then the fire department suing you for not using the right hose.

In the end, this matter will go before the United States Supreme Court, where Judge Bolton may not fare so well. It is inconceivable that a federal judge - who knows the residents of her state don't feel
safe, even in their own homes - would reward the Federal Government for not doing its job.

Let's hope that the U.S. Supreme Court applies the law properly and lets the states do their job when the federal government won't.

    I really thought, from the info here at Huck*PAC that Mike's new Show was going to be strickly on the cable networks. To my surprise and enjoyment, local Fox affiliate, Minneapolis KSMP Channel 9 is one of the Seven local stations "testing" the ratings.

    With Jill 4 America's bright post,(thanks again Jill!) to me yesterday, I found out all the areas that are airing this show locally.

    I say we need to BUY-cot Arizona and if they do approve the building of the Mosque in NY, I say we need to BOY-cott New York. We need to do all in our power to get rid of the New York mayor as well. He paid for his election. Bought it in full with his billions...its a crying shame whats going on in this country of ours...

    Thanks for the info. Jill 4 America, as I have added the Huckabee website to my favorites list. I actually did read the blog on this site that you are referring to, even posted a response. The blog didn't give any info that it was going to be local. I was very excited to hear that it was going to be aired on our local station (laughing) as you can tell from my previous post.     Here is the link to the Ellis Island history on immigration. People had to have paperwork that identified who they were and where they came from. Unlike what is happening at the border's today.

    I read Listen and value balanced reporting, and as a legal immigrant with all the
    health, criminal, social, financial background clearances, I personally waited, I made
    the required payment of dues.
    I understood that Immigration means assimilating into the
    society, and paying my taxes.
    Then right now in horror watching people forcing their... way into the USA, demanding that
    we learn their language, parading in street marches waving their own countries flag
    in the face of the USA, refusing to be law abiding…..!
    America is 80% immigrants from all other countries, Italians, Swedes, Germans,
    Asians, Chinese, etc, they all were proud to become Americans, obey the laws,
    learn the language, put aside their heritage and become assimilated.
    So I have this to say about the problem facing America today.
    This is not an Immigration issue.
    This is an….
    Invasion, the arrival of large numbers of people or things at one time. Incursion,
    a spoiling of something by interfering with it or taking some of it away.
    Offensive, causing anger, resentment, or moral outrage.
    Immigration is the act of entering a new country to settle permanently the
    control point at an airport, seaport, or border crossing where people entering
    a country must stop to have their passports officially checked.
    Legally recognized or established by a court of law, rather than a court of equity.

    If you are like me ... it is just hard to get around sometimes to reading all that I would really like to read.

    I saw the Huckabee show all last week at 1:00 p.m. on our local Dallas station KDFW Fox4.
    I missed it today ... but it certainly was worth watching last week ... Excellent show!
    I am glad that it shows in your area as well !! ... If I am correct I heard Gov. Huckabee say that it would be showing for about 6 weeks and then if it is proven successful it will be seen nationwide after the 1st of the year.

    Thanks Peter for the information about the Huckabee show on local Fox News channels. I will search for the show. I hope it is in Jacksonville, Fl.

    I agree AZ should be allowed to fight their own battles without being sued by the Federal Govt. If the immigration authority and other federal agencies did their job and enforced the laws, we would not have an over flow of illegals.

    I don't think we can close every mile of the border, because if we build a fence the illegals either, tear it down, go over or go under. What we can do is take away what is bringing many of the illegals here. Change the anchor baby law, penalize those hiring illegals and fire the agencies who look the other way when someone reports a case where someone is using invalid identification. I am sure there are even more ways to deter illegal entry. Oh, take away the possibility of Amnesty.

    Enforce the laws and hold the agencies in charge accountable. There are many people who are out of work that can be trained to do their jobs.

    Although my grandparents came through Ellis Island. they came here Legally. but, this is ridiculous they our draining our system dry the schools are over crowded health care is affected most federal programs are for those who should not be here and we are paying for all of it it is time for everyone to step up and say no more I agree with the Arizona GOV. Pay taxes and come here legally. No other country in the world puts up with this we are a laughing stock. I love this country and they are making it so that a decent person cannot get what they need because a non citizen has already taken it.. If you are here Illegally you and your family should be sent back including the children. I know this is harsh but it is the only way to get the point across. Born here of illegal parents is illegal Period.. thank you.

    I know that this has nothing to do with this blog, but I just found out tonight that the Huckabee Show is airing on our local KMSP channel 9!!!! In fact, it has already been on last Monday and Tuesday! I had no clue of this since I have renounced the local (mainstream) media. The only way I found out about it was my wife was watching KMSP channel 9 FoxNews, and she heard that it will be on tomorrow at 9:00 A.M.! I am so EXCITED!! It seems that Fox affiliates are testing the Huckabee Show on only SEVEN local stations in the Country, and Minneapolis, KMSP Channel 9 is one of the seven!

    I will be watching tomarrow! YAYYY!

    Why didn't Huck*PAC write a blog about the seven local stations that were going to be testing and airing Mike's Show? Mike needs to beat out "The View" (UGH!) as it is on at the same time. Mike needs good ratings! Maybe this is news to Huck*PAC? I'm not sure what the other six localities are, but maybe it should be looked into and a blog be written. Peter

    Gov. Huckabee,
    As you can see by me email address, I hail from Arkansas. I was proud to call you MY GOVERNOR.That said, I want to add my comments to those here.
    I know of several people who came here illegally with their parent(s)as young children. They are still illegal adults. They went to our schools, doctors, hospitals, and universities. No one reported any of this. Why???
    I think the reason the judge ruled the way she did is that she is like all those I mentioned above. "Don't rock the boat".
    I don't know the answer, but it isn't amnesty. It didn't work in 1986, it won't work now. I was born in a Navy hospital in France. I do have a certificate of birth abroad. I got flack from every school I entered and any institution I had to present a birth certificate to. This included the State Board of Nurse Examiners. It is simply amazing how the real American Citizen is treated in comparison to the illegal immigrant!
    We need to send a message to those who are running our country in the ground! Leave office and go to those countries you favor over this one, and take those who pay you to look the other way with you!
    I am afraid if taken to the US Supreme Court at this point, the judge's ruling will stand. After all, the last 2 justices appointed were selected by Obama Bin Laden himself and upheld by his cronies.
    I, too am packing in my home. I am working on a concealed weapon permit. I don't feel safe just driving down the road and stopping at a light! This is MY country. I hate seeing it go to hell. But, then, Obama might not be the actual Antichrist, but he is sure paving the way for him to come to power.

    Mr. Huckabee, I hope you will have the same message on Illegal Immigration in 2012. I will never support an amnesty mistake as happened in 1986.
    I live alone now since my wife passed in 2002 and keep two shotguns loaded at all times. I got my concealed handgun license in 2008 and pack a pistol at all times. I have never felt the need to defend myself as much as I do now. Here in Texas the illegal problem is over twice that of Arizona in numbers of them. The crime rate in our small city is twice what it has ever been. I am flat out tired with Obama and crew buying votes from Latinos at the expense of the citizens of this country. We don't need new laws, we need to enforce the ones that we have. There are over 20 states looking at similar laws to Arizona who will be looking for the outcome of this issue on the Arizona law. It is apparent that the 9th court is too Liberal to even take the case until November to protect the Democrats during the midterms.

    We need to take back the House and Senate this year and get rid of Obama and his agenda in 2012. It will take a generation to correct the damage done to the country by the Democrats since January 2007 and Obama since January 2009. Illegal immigrants cost this country over $103B a year for their medical care and social services, not to mention the cost of having to jail them until we can deport them. We need a government and president strong enough to ignore the ACLU, NAACP and all of the other groups and do the right thing for America and that just isn't hapening when politics come first with theis bunch.

    How is it that there are millions of US citizens out of work and yet we have millions of illegal workers here with jobs we don't want or like. If there is a job out there thet could be filled by someone unemployed, it shuld be a requwirment thet that job first be offered to that unemployed US citasan. If the owner of a business hires an illegal worker rather than give the job to a U.S. citizen he should have to pay twice as much in tax on the illegal than he would have on the legal worker. This would help pay for the unemployed workers benefits thet are now payed at the taxpayers expence. If the employer breaks this law, he should have to pay a stiff fine or jail time. No plea bargaining should be allowed. If the legal worker won"t take the job he or she shuld loos there unemployment benefits. If our lawmakers would make laws for our country rather than for there re-election,our country would not be in the shape it's in today. Get the country back on track. Stop career politions from making laws for their re-elections and instead for our country. We must start taxing companies that hire illegals so they will hire US citizens. We must stop giving a free ride to people that won't work a job they don't like, if there are no other jobs to be found. Let them downsize until the economy gets better rather than break the U.S. with unemployment benefits. How can this be wrong if it's for the good of the country. We must somehow add a government law or amendment to our constitution that provides term limits to stop politicians from killing our country. Get our politicians out of the pharmaeutical industries pocket so we can legally buy drugs from other countries. That way the taxpayer isn't stuck paying to make there CEO and top cronies billionaires. Elected government has gotten fat and lazy. They have hired hundreds of employees to do the work, so they can become highly payed public speakers. They no longer care about their country. They only care about re-election to keep their free insurance and retirment. Who cares abuot what is right for our country as long as there is a back room deal to be made with a CEO, lobbyist or coworkers that knows of a lobbyist with deep pockets. They have contributed more to the decline of this country than all of the U.S. world enemies combined. How do we get our country back on track, without term limits. Our lawmakers can't retire in the system and make laws with good judgment for all americans if they don't have to live under the same laws. Everyone I talk to feels the same way as I do. Help get America back on track.

    I am 100% for Arizona. The Federal Government had their chance for the law had been passed for them to protect the borders,but they did not. Had that been one of us they would put us in prison and I feel that is where they should be for Arizona is doing what needs to be done!!!

    I was stunned when I heard the judge's decision, It actually made me physically sick. I cannot understand how such a simple law can be so distorted. I truly fear for our country, after all we have been through as a nation, I may very well see it's demise, I am 67 now. the sad thing about it is that these people coming in illegally are not trying to become Americans, they want our country to become Mexico, I was taught in the eighth grade that to become a citizen, you basically gave up your old alliances and accepted our laws and customs. This is not the case anymore.I am not sure that even the Nov elections can save us, there is just too much damage being done daily, sorry for rambling. Thanks.

    Gov. Huckabee,

    What else should we expect from a federal judge appointed by Clinton?

    Instead of using this analogy;

    "That's like you using a garden hose to put out a fire at your own house - and then the fire department suing you for not using the right hose."

    I would use one like this;

    "That's like trying protect your family in your own home from a burglar or murderer and then getting sued by the police who decided that day not to do their job".

    Arizona is a "home" to many law abiding citizens. The "Head of Household", (elected Officials) are just trying to do thier job and protect the occupants (law abiding citizens) of the "house" (Airzona).

    I'm sure that the elected Officials took an oath to protect their citizenry!
